OpenAI lawyers question Meta’s role in Elon Musk’s $97B takeover bid 

Court documents made public Thursday show that OpenAI has requested Meta provide records about any collaboration or conversations with Elon Musk and xAI regarding a possible takeover of the ChatGPT-maker.

According to the filing, which relates to Musk’s lawsuit against OpenAI, the company subpoenaed Meta in June for documents tied to Musk’s $97 billion unsolicited offer in February. OpenAI ultimately rejected the proposal, and it is not known if the requested records exist.

The subpoena is connected to Musk’s case opposing OpenAI’s decision to restructure its for-profit arm into a public benefit corporation, which OpenAI says is crucial for attracting outside investors and eventually going public. Musk argues the change contradicts the company’s mission at its founding.

Meta’s attorneys have called on the court to dismiss the subpoena, stating that Musk and xAI can provide any necessary documentation and that Meta’s internal discussions of OpenAI’s restructuring have no bearing on the case.
